Privacy Statement

At Fernweh UK, we take your privacy seriously. The following is our Privacy Policy, which contains detailed information on how and why your information is collected, used and shared when you visit or make a purchase from our website (www.fernwehuk.com, referred to as "the site") and how we keep your information secure.

SECTION 1 - WHAT INFORMATION DO WE COLLECT?

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

1.1 - When you purchase something from our store or attempt to make a puchase, as part of the buying and selling process, we collect the personal information you give. We refer to this information as “Order Information”. 

1.2 a) -When you browse our store, we also automatically receive your computer's Internet Protocol (IP) address; this automatically collects certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device 

b) - Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.

1.3 - When someone visits our Site, we use a third party service, Google Analytics, to collect standard internet log information such as the information above in 1.2 b and visitor behaviour patterns. This is only used to find out data such as which products are clicked most and which areas of the site have most visitors. This information is anonymous and is never processed in a way that can identify anyone and we do not allow Google to attempt to identify anyone who visits our website.

1.4 - Email Marketing: With your permission, we may send you emails about our store, new products and other updates.

SECTION 2 - WHAT DO WE DO WITH YOUR INFORMATION?

2.1 - We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).
Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services


2.2 - We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

2.3 - If you have signed up to our mailing list, we collect the personal information that you enter on the sign up form (name and email address.) We use that information to send you occasional email updates on new products, special offers, events that you have asked to receive updates about. We do not sell or trade email lists with other organisations and only share your data with our trusted third party providers to help us complete our service.

SECTION 3 - SHARING YOUR PERSONAL INFORMATION/DISCLOSURES 

Information about our customers is important to our business, and we require it to complete daily tasks such as order fulfilment or for optimising our website. We also value your privacy and only share your personal information for very limited reasons, as follows. We only ever use trusted third party providers who meet strict privacy guidelines such as GDPR or the EU-US Privacy Shield. 

3.1 - We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Shopify to power our online store--you can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy

3.2 - As mentioned earlier in this Privacy Policy, we also use Google Analytics to help us understand how our customers use the Site -- you can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/. 3.3 - We use a third party company called Mailchimp to delivery our email newsletter. We use Mailchimp gather statistics around opening/link clicks to measure how successful each email campaign is using Mailchimp's industry standard technologies. 3.4 We also use trusted third parties to provide services/functions to our Site such as delivery companies like Royal Mail. We only every share the minimum information necessary to allow them to perform these services, such as name/delivery address to allow Royal Mail to deliver our products.

3.5 - Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

SECTION 4 - CONSENT

How do you get my consent?

4.1 - When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

4.2 - If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

SECTION 5 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 6 - BEHAVIOURAL ADVERTISING

As described above, we may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. SECTION 7 - COOKIES

Cookies are implemented on our store built by Shopify. Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.
_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 8 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways like Paypal and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 9 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

We encrypt all hardware that is used to access your information such as laptops and use secure password protection and two step authentication log in where ever possible. 

Any information that is stored in hard copy, such as invoices for our book keeping records are stored in a secure, locked location.

SECTION 10: YOUR RIGHTS

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site, www.fernwehuk.com), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

SECTION 11: TRANSFERS OF INFORMATION OUTSIDE THE EU

We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we are deemed to transfer information about you outside of the EU, we rely on Privacy Shield as the legal basis for the transfer, as Google Cloud & Microsoft Cloud are Privacy Shield certified.

SECTION 12: DATA RETENTION

When you place an order for a Fernweh item through our Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

We retain your personal information only for as long as necessary to provide you with my services and as described in our Privacy Policy. However, we may also be required to retain this information to comply with our own legal and regulatory obligations such as tax laws, to resolve disputes, and to enforce our agreements. I generally keep your data regarding orders for the following time period: 7 years.

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given, us your consent to allow any of your minor dependents to use this site.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
